Terms & Conditions
These Terms and Conditions form a binding legal agreement between you (the “Customer”) and **Azhar Engineering**, owner of the “Sonik Mobility” trademark, with registered office in Noida, Uttar Pradesh, India. By accessing or using the Sonik Mobility App or a Sonik Mobility EV charger, you accept and agree to be bound by these terms.
Definitions
- **Agreement:** These terms for use of the Sonik Mobility App.
- **Charging Stations:** EV charger units where you can charge your vehicle.
- **Charging Session:** The duration between starting and stopping a charge.
- **Device:** Your phone, tablet, or other device used to access the App.
- **E-Wallet:** Prepaid account in the App to store funds for payments.
- **Charging Fees:** Fees charged for each charging session.
- **Payment Facilitator:** Third-party payment processor (e.g. Razorpay or another).
- **Promotional Credits:** Referral bonuses, cashback, or credits given by Sonik Mobility.
- **Services:** The charging services and related services offered via the App.
- **Website:** Sonik Mobility’s website (sonikmobility.com).
Use of Services & App
Sonik Mobility offers its services via **Charging Stations** that may be owned by Sonik Mobility or third parties. You are granted a **non-exclusive, non-transferable, revocable, limited license** to download, install, and use the App for personal use on your own Device.
For registration, you must provide your mobile number (validated by OTP) and a valid email address. Each mobile number corresponds to a single account.
Payments & E-Wallet
You can recharge your **E-Wallet** in advance using credit/debit card details and OTP via the App. Sonik Mobility uses a **Payment Facilitator**; this is an independent party, and Sonik Mobility is not liable for errors or failures caused by the Payment Facilitator. Sonik Mobility bears the transaction cost, and you will receive the full amount in your E-Wallet.
Charging Sessions can be started/stopped via the App (depending on the charger), or via a Charge Card (if supported). Sonik Mobility may **suspend your account indefinitely** if terms or payment obligations are breached. Usage history and transaction details are stored in the App; for older records, you may contact support.
Equipment & Charging Stations
Charging speed depends on vehicle specs, battery condition, weather, and station capacity; **Sonik Mobility cannot guarantee any specific charging time.** Instructions for using the charging stations are available on the station or via the App.
Charging Fees for each session will be displayed in the App or at the station. By using the services you agree to pay those fees.
Service Availability
Sonik Mobility services are intended to be available **24/7**, except for scheduled maintenance or downtimes. Charging Stations might be inaccessible at times due to factors beyond Sonik Mobility’s control; the App will reflect current availability.
Sonik Mobility reserves the right to modify, restrict, or suspend services or access without liability (for updates, maintenance, error correction, force majeure, etc.).
Data, Usage & Privacy
Sonik Mobility collects and stores charging history (usage, duration, electricity consumed). Customer personal data is processed under applicable laws and Sonik’s privacy policy. Data may be used for product development, marketing, and analytics, unless you explicitly opt out of direct marketing.
You must back up, secure, and protect your data; in case of data loss, Sonik may attempt to restore from backup but is not obliged to reconstruct lost data. Sonik may share your data with third parties for service performance, analysis, or anonymized statistics.
**Customer indemnifies Sonik Mobility for claims arising from misuse of data by the customer.**
Warranty & Disclaimers
Sonik Mobility warrants performance in line with its policies and efforts. However, use of the App/Services is at your **own risk**; Services are provided **“as is” and “as available.”** Sonik disclaims warranties including implied ones (merchantability, fitness, non-infringement).
There is **No guarantee** that Services meet your expectations, or operate uninterrupted, timely, securely, or error-free. Sonik is not liable for damage if your vehicle and charger are incompatible or misused. Incidental or consequential damages are excluded, and you cannot claim damages for a station being out of order.
Limitation of Liability
Sonik Mobility (and related parties) are **not liable** for loss of use, revenue, profits, or diminution in value, or indirect, consequential, special or punitive damages. Sonik is not liable for personal injury or damage to third‐party property caused via services.
Sonik’s maximum liability is capped at the amount received by Sonik for services in the **15 days prior** to the event giving rise to the claim.
Governing Law, Disputes & Arbitration
The Agreement is governed by **Indian law** and disputes are subject to courts in **Delhi, India**.
If the parties fail to settle a dispute amicably within 30 days, it will be referred to **arbitration** under the Arbitration & Conciliation Act, 1996, held in Delhi, in English.
General Provisions
Validity, Termination & Amendment
The Agreement remains valid indefinitely until terminated. Sonik may **terminate your access at any time**, with or without notice, if you breach terms. Sonik may **update or amend** the terms from time to time; continued use after updates implies acceptance.
Force Majeure
Sonik is **not liable for failure to perform** due to circumstances beyond its control (e.g., pandemic, natural disasters, power failures, war, strikes, network failures).
Severability & Survival
If any provision is found unenforceable, it is enforced to the maximum extent possible, and the remainder remains valid. Rights and obligations that by nature should survive termination will continue.
Order of Precedence
In case of conflict between this Agreement and other Sonik Mobility terms, **this Agreement prevails** for App/charger usage.
